    Digital Forensics and Electronic Discovery Review

    E-discovery helps inform the “what” of a given scenario and forensics can help identify the “how” and “when.” Forensics and e-discovery share a goal; to locate digital evidence to support investigations or fact discovery. E-discovery is content-based but digital forensics focuses more on context.  This presentation will discuss how forensics can tell the rest of the story through deleted information, authentication, and user activity. We also discuss some of the cool things forensics can do.

    Upon opening his own solo law firm RJon fell flat on his face. But then he quickly realized that despite having done quite well in law school, completing a prestigious 9 credit internship with the US Trustee’s Office and clerking for a Federal Bankruptcy Judge, he knew next to nothing about how to actually manage the business of a small law firm.

    The Trial of Billy Michael Thompson Oklahoma County CF-2010-5654

    On Tuesday August 17, 2010 Billy Thompson was at his home when drunken guests arrived. Manuel Sanchez, Jose Padilla, Max McIntire, and David Hedspeth sat outside Billy Thompson's home, drinking and smoking marijuana.  Jose Padilla had a cigar that everyone was sharing. Billy Thompson was heavily intoxicated (as were the others), and had possession of the cigar. Jose then demanded the cigar back. Billy refused, and Jose took the cigar from Billy. Billy got angry, and punched Jose in the face in order to get the cigar back. Max saw Billy hit wheelchair-bound Jose, and took offense to Billy's actions. Max savagely beat Billy on two separate occasions that evening.  Billy yelled at all of the guests to leave his property, and retreated into his home to retrieve a knife to defend himself.  Billy walked back out of the house, into his front yard and proceeded down his driveway with knife in hand to make sure all the guests were gone. As Billy got to the side of his house, he was attacked for a third time by Max McIntire and Manuel Sanchez. Billy fatally stabbed Manuel Sanchez, and wounded Max McIntire. Little did Billy know, this is when his real nightmare would begin.  Billy was arrested for Murder in the First Degree, and nearly two years after his arrest, Billy proceeded to trial in which he was convicted and given a sentence recommendation by the jury of Life imprisonment, and seven years for the stabbing of Max McIntire. This verdict was ultimately set aside due to Prosecutorial Misconduct, wherein the Government hid a witness and did not reveal exculpatory evidence in the form of eyewitness testimony.  Both Government attorneys were fired due to this misconduct, and have pending disciplinary actions before the Oklahoma Bar Association. A new trial date was set, and new Defense Attorneys were appointed to represent Billy.  And now the trial for Billy Thompson's life begins
