Attacking the Expert's Opinion at Deposition & Trial - Part 1

The adverse expert is typically the most dangerous witness because he testifies cloaked in the mantle of the “unbiased scientist.” Thus his testimony, if accepted by the trier-of-fact, can determine a key issue, maybe the entire case.

There is one right, logical method with which to effectively attack that testimony at deposition or trial no matter the area of law, no matter the field of expertise. As never before, this seminar brilliantly elucidates that logical method and teaches the archetypal set of integrated questions that are at the heart of every great cross-examination of an adverse expert.

Topics Covered:

*  Introduction of the seminar's "Mt. Olympus" adverse expert witness

*  Attacking the expert's pedestal

*  Deposition cross-examination logic re "fact" witnesses vs. experts

*  When attacks against expert should be road-tested at deposition

*  The structure of every expert opinion

*  End point opinions

*  Subordinate opinions

*  Bedrock findings & assumptions

*  The seminar's case facts explained

*  Cross-examiner's critical listening skills

*  The every-case-forever chart re the universe of attacks against an opinion's purported merits

*  Five categories of expert opinions

*  Two must-be-asked depo questions

*  Ten types of expert rules

*  "Opinion" in court vs. outta court

*  X and Y factors defined

*  Scientific vs. experiential rules (science vs. art)

*  Scientific rules & Sir Francis Bacon

*  Experiential rules and the "you-gottatrust-me" expert

    Digital Forensics and Electronic Discovery Review

    E-discovery helps inform the “what” of a given scenario and forensics can help identify the “how” and “when.” Forensics and e-discovery share a goal; to locate digital evidence to support investigations or fact discovery. E-discovery is content-based but digital forensics focuses more on context.  This presentation will discuss how forensics can tell the rest of the story through deleted information, authentication, and user activity. We also discuss some of the cool things forensics can do.
